Introduction:

Welcome to chiltonsantiques.com.au and thank you for shopping with us. These are a list of the Terms and Conditions that govern the use of this website. Should you have any questions, please contact us on (02) 9524 0360 prior to placing an order.

Security:

We want you to be able to order from Chilton’s with total confidence. To place your order with us all you need to do is contact us by letter, fax, telephone or email (chiltonsmiranda@bigpond.com.au )

Remember to include your contact details and a clear description of the piece you are ordering.
Shipping:

Domestic - $10 for each order to each address inclusive of insurance

International - Please phone or email for a postage quote. Presently we ship to all countries using different types of couriers depending on size and price of parcel.

If you would like a registered delivery (signature required) extra costs will be incurred.

Delivery:

Chilton’s aims to have all products delivered domestically within 3 working days if the items are in stock. Those items that are not in stock can take longer. We will always notify you if this is to be the case by email or phone. Remember antique pieces are original and there is only one of each item available. Please allow 12-15 working days for delivery of international orders. Please specify when ordering if you require your parcel to be delivered on or before a particular date and we will endeavour to have it there at that time.

Credit cards:

We accept all types of credit cards in store only, meaning this type of payment will only be accepted by having the card and cardholder present for the transaction. No credit card payments will be accepted online.

Money Orders, Direct Debit & Personal Cheques are the only other forms of payment we accept for online sales. This is not only to protect Chilton's Antiques, but to protect you, the consumer as well. The goods will then only be sent after these have been cleared.

Pricing:

All prices, including quotes that are displayed on our web site are in Australian dollars and include the GST. Prices and quotes are correct at the time of printing but are subject to change without notice. All items of antique jewellery offered are individual, one off pieces that are priced on rarity, stone content, gold carat weight and age. Quotes remain valid for 30 days.

1. in relation to goods, the replacement or repair of the goods, the supply of equivalent goods, the payment of the cost of replacing or repairing the goods or the payment of the cost of obtaining equivalent goods; and
2. in relation to services, the supplying of the services again or the payment of the cost of having the services supplied again.

Placing and Accepting Orders:

Gift Vouchers:

Gift vouchers are not redeemable for cash and expire one year to the date of their purchase.

Cancellation by us:

We reserve the right not to provide goods or services, terminate accounts, remove or edit content or cancel orders (or part thereof) at our sole discretion at any time. Without limiting the operation of any other Terms and Conditions herein, we will not be held liable for loss or damage arising from the exercising of these rights.

Cancellation by You:

If you need to cancel an order, please contact us immediately by phone on (02) 9524 0360 or by fax (02) 9525 6625 or email chiltonsmiranda@bigpond.com. Our agreement with you only comes into existence once we have both confirmed your order and your payment has been processed. Once we have accepted payment for an order, cancellation of the order is within our sole discretion. Orders that cannot be cancelled will be subject to our terms, conditions and policies relating to Returns and Exchanges.

Delivery:

It is your obligation to enter the correct delivery address details at the time of ordering. Should you enter the wrong address, we are not obliged to re-send the order to the correct address at our expense.

We will provide you with an estimated date for delivery of all parcels. While we make every effort to deliver by this time, all dates specified are estimates only.

It is the responsibility of the customer to inform Chilton’s Antiques if an order does not arrive. Once we learn an order has not arrived by the due date, we will lodge enquiries with the courier to ensure delivery occurs as soon as possible. We will not be held liable for any loss or damage resulting from late delivery.

Please note that if an item has been lost in transit, we will not dispatch a replacement. Replacement items will be dispatched according to our discretion.

As a guide only, our couriers attempt to deliver to business addresses between 9am and 5pm, and to home addresses up until 6pm. Unfortunately, we are unable give a guaranteed time of delivery.

You may select the "Recipient to sign for delivery" option when placing an order with us. By doing so, you agree that we have satisfied the condition where a signature has been received from the recipient, appropriate agent or proxy recipient of the order (chosen at the courier partner's discretion). You agree that in doing so we have delivered the order within the terms of the agreement between you and us.

If you do not select the "Recipient to sign for delivery" option, you agree that when our courier partner is satisfied that the order has been delivered, delivery of the order has taken place within the terms of the agreement between you and us.

Without limiting the operation of any other Terms and Conditions herein, you agree that late delivery does not constitute a failure of our agreement, and does not entitle you to cancellation of an order.

Returns, Exchanges & Refunds:

These rights are from the Department of fair Trading legislation:

You or the recipient of an order may return any items that have been purchased from chiltonsantqiues.com.au within 14 days of purchase. If you have changed your mind or are unhappy with a purchase we offer a store credit only.This is valid for 6months from the date of purchase.

If you return goods via an Australia Post Office, please keep the appropriate proof of return. Otherwise, if the returned item goes missing in transit to us, we will deem you not to have returned the item.

It is your responsibility to ensure the goods are adequately packaged to ensure that they are not damaged during return transit. We will not issue a return or exchange unless the product/s are in a saleable condition upon return. We will not exchange on goods that have been engraved or altered in any other way. In cases where you should return a ring that has been resized to fit you & a charge has been applied this will be non refundable & will not count towards your store credit.

We do not refund so choose wisely!

Consumers may ask for a refund if the goods purchased:

Have a basic, serious fault that was not known by the consumer at the time of purchase

Do not do the job that the consumer was led to believe they would do.

Do not match the sample the consumer was shown, or .

Does not fit their description.

When are consumers not entitled to a refund?

Consumers are not entitled to a refund when they:

Change their mind about a product. This includes when a consumer has found a cheaper product elsewhere, has bought a gift that is unsuitable, or their circumstances have changed and they no longer require the goods

Knew, or should have known about a fault when the goods were bought, for example as seconds. However, if a second has a fault that the consumer was not aware of, or could not have discovered upon a reasonable inspection when the item was bought, their rights are not affected.

Goods tagged A/F - indicate minor damage & are sold as is. These have been priced accordingly.

Are unable to prove from whom and when the item was purchased. However, traders should not refuse a refund solely because there is no receipt, if they are satisfied that the goods were purchased from their store

Are responsible for damaging the goods by not following the instructions, or misusing the product.

What obligations do consumers have?

If a consumer wants a refund they should:

report the details of the fault or take the goods back to the trader as soon as possible

state what remedy they would like.

provide proof of purchase when returning the goods.

be sure that they did not cause the fault.

stop using the faulty item.

Make sure they care for the goods while in possession.

Rights of a trader:

A trader does not have to provide a refund if:

no proof of purchase is offered.

customers simply change their mind

the goods have been damaged by abnormal use after purchase, or Customers knew, or should have known about any faults when they bought the goods, for example as seconds. However, if a second has a fault that the customer was not aware of, or could not have discovered upon a reasonable inspection, at the time of purchase, they would be entitled to a refund. This is not the case when goods are tagged A/F showing that they have minor damage & are priced & sold accordingly.

Terms & conditions of Lay-Bys:

At Chilton’s we offer a lay-by service which we:

Require a minimum deposit of 10% of the purchasing price,

Lay-bys must be completed within 90 days unless advised otherwise

If lay-by is not completed within the 90 days, it is the prerogative of Chilton’s Jewellery & Antiques to cancel or extend such lay-by

If the lay-by is cancelled by a customer or a lay-by exceeds the 90 days & if Chilton’s is contacted within the 90 days a credit note will issued otherwise the money will be forfeited.

Exchange of goods must be within 14 days of sale
